Terms of Service
The rules that protect every transaction on Gygnus — including our 6% platform fee on job payments and separate estimated card processing borne by providers, plus our free-to-use platform policy and anti-circumvention policy.

1. Agreement to Terms
By accessing and using Gygnus ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These Terms form a legally binding agreement between you and Gygnus Inc.
2. Platform Definition
Gygnus is a marketplace platform, not an employer or employment agency. We facilitate connections between customers seeking services and independent service providers.
All service providers are Independent Contractors. They are not employees, agents, or representatives of Gygnus. Service providers operate their own businesses and are solely responsible for their own taxes, insurance, and legal compliance.
3. Fee Schedule
Gygnus charges nothing to customers. Posting a job, receiving quotes, messaging providers, and paying for work is completely free. No hidden fees, ever.
Signing up, applying for jobs, and browsing is completely free. On completed job payments, Gygnus retains a 6% platform fee, and estimated payment processing (e.g. card fees) is deducted separately from the provider's payout. The same processing model applies to separate tip charges.
Six percent of the agreed job payment is retained by Gygnus when the job is completed and paid. This is our marketplace platform fee.
Estimated credit-card and processor costs are deducted from the provider's payout on each paid charge (job payment and tips, when processed separately). Your net is the agreed amount minus Gygnus 6% minus these processing estimates.
Customers pay zero fees to Gygnus — ever. You pay exactly what the provider quoted, nothing more.
4. Escrow and Payment Terms
Funds are held in secure escrow after job completion to ensure satisfaction for both parties. The hold period depends on your provider tier:
Job payments and optional gratuities ("tips") may be processed as separate charges through our payments partner, Stripe. Checkout may support card payments and, where enabled by Stripe and your device, digital wallets (for example Apple Pay or Google Pay). Tips are not part of the quoted job escrow amount; when charged separately, estimated card processing still applies on the provider side as described in the fee schedule.
- ✦Payment Process: When a job is completed, the customer marks it as complete and funds enter escrow.
- ✦Dispute Period: Both parties may file a dispute during the escrow hold period.
- ✦Automatic Release: If no dispute is filed before the hold period ends, funds are automatically released to the provider.
- ✦Customer Protection: Funds remain in escrow until you confirm satisfactory work.
- ✦Provider Protection: Once the escrow period ends, payment is guaranteed.
Trusted Provider — 7-Day Payout
UnlockableProviders who meet either of the following criteria qualify for a 7-day escrow release instead of the standard 30 days:
🔒 Persona Verification
Complete optional identity verification through our third-party partner, Persona. This removes liability from Gygnus and confirms your real-world identity without us storing any government documents.
⭐ Performance Tier
Complete 50 or more jobs with an average rating of 4.5 stars or higher. Your track record earns you accelerated payouts automatically.
Payout tier status is determined by the platform at the time of job completion and is not subject to dispute.
5. Dispute Resolution
Gygnus Administration is the final arbitrator for all platform disputes.
- ✦Either party may file a dispute through the platform within the 30-day escrow period.
- ✦Both parties will be asked to provide evidence (photos, messages, documentation).
- ✦Gygnus Admin will review all evidence and make a binding decision.
- ✦Decisions typically rendered within 5–7 business days.
- ✦Possible outcomes: Full refund, partial refund, full payment to provider, or split resolution.
- ✦Admin decisions are final and binding with no appeals process.
6. Liability Waiver
By using the platform, you acknowledge and agree that:
- ✦Service providers are independent contractors, not Gygnus employees.
- ✦Gygnus does not control how providers perform their work.
- ✦Gygnus is not responsible for the quality, safety, or legality of services provided.
- ✦Gygnus is not liable for property damage, personal injury, or financial loss resulting from services.
- ✦Gygnus's maximum liability is limited to the platform fees collected for the specific transaction.
- ✦If a provider causes damage and cannot pay, Gygnus is not a guarantor or insurer of the provider's obligations.
7. User Responsibilities
Customer
- ✓Provide accurate job descriptions
- ✓Be present during scheduled services
- ✓Pay agreed-upon rates promptly
- ✓Treat providers with respect
- ✓Leave honest, factual reviews
Service Provider
- ✓Hold necessary licenses and insurance
- ✓Arrive on time for scheduled jobs
- ✓Complete work as described
- ✓Maintain professional conduct
- ✓Comply with all applicable laws
8. Anti-Circumvention Policy
Strictly EnforcedUsers are strictly prohibited from arranging payments outside of the Gygnus platform for any connections made through our services.
💰 Protection Fee
If a user is found to be bypassing platform payments, Gygnus reserves the right to charge a $500 Permanent Referral Fee per instance — billed immediately.
⛔ Account Termination
Bypassing the platform results in an immediate and permanent ban for both the Customer and the Provider involved — with no appeal.
9. Prohibited Activities
- ✗Using the platform for illegal activities
- ✗Bypassing platform payments (see Section 8)
- ✗Posting fake jobs or fraudulent listings
- ✗Harassing or threatening other users
- ✗Sharing account credentials
- ✗Scraping or copying platform data
- ✗Posting spam or malicious content
- ✗Impersonating other users or staff
10. Account Termination
Gygnus reserves the right to suspend or terminate accounts that violate these terms. Violations may result in:

- →Withholding of payments for pending disputes
- →Legal action for fraud or illegal activity
11. Intellectual Property
All content on Gygnus, including logos, design, text, and software, is owned by Gygnus or licensed to us. You may not copy, reproduce, or distribute our content without express written permission.
12. Privacy and Data
Your use of Gygnus is governed by our Privacy Policy. By using the platform, you consent to our data practices as described in that policy, including geolocation collection and payment processing through Stripe.
13. Governing Law & Arbitration

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
🔒 Mandatory Arbitration
Any dispute arising from these Terms will be settled via private, binding arbitration in New Jersey rather than in court. By using Gygnus, you waive the right to a jury trial or class action lawsuit.
14. Indemnification
You agree to indemnify, defend, and hold harmless Gygnus LLC, its members, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

- ✦Services you perform or receive through the platform.
- ✦Your violation of these Terms of Service.
- ✦Your violation of any third-party rights, including privacy, intellectual property, or property rights.
- ✦Any false, inaccurate, or misleading information you provide during registration or platform use.
- ✦Any harm, injury, or property damage caused by you or resulting from your services.
